Tax on Gaming in India to be reviewed in March: Govt Official

India will begin reviewing the tax regime that governs sales taxes for gaming companies that operate online from next month, according to an official from India’s finance ministry’s top rank. Last year saw disruption in Indian markets when state finance ministers led by Union Finance Minister Nirmala Sitharaman initiated action.

India’s gaming industry was given an unexpected blow in 2000 when a group of finance ministers led by Nirmala Sitharaman decided to increase taxes by 28 percent for sectors experiencing rapid expansion during pandemic. After much consideration and discussion by Goods and Services Tax Council, it was agreed to review these increases within six months.

Implications of Tax on Gaming in India:

Revenue Secretary Sanjay Malhotra revealed during an interview on Saturday that gaming companies will need their tax structures analyzed by the government after March. Since October 1 when online gaming businesses were subjected to new taxes from October 1-January 1 (he stated 34.7 billion dollars ($418 million was paid as taxes only up until January). He estimated the government may collect 140 billion rupees by 2024-25.

Delta Corp. and Tiger Global, which back Dream11, have seen notices and tax demands rise due to authorities’ crackdown on tax evasion. According to information revealed during sessions of Parliament last December in reports by the Finance Ministry, tax officials issued up to 71 notices totalling 1.12 trillion rupees during 2023-2024 fiscal year to gaming firms that violated GST rules totalling more than 1.12 trillion rupees during that year.

Sanjay Malhotra announced that 53 online gaming companies had their accounts suspended due to failing to abide by tax regulations. With respect to capital gains tax laws pertaining to sales of securities listed or not listed for trading, Malhotra indicated that modifications or reductions of tax structures may be considered when they present the budget in July.

From January 26th to January 28th, 2024, the vibrant atmosphere echoed with the excitement of game developers, and designers alike, converging to participate in this international event.

The Global Game Jam (GGJ) serves as a remarkable testament to the boundless power of collaboration and creativity that transcends geographical limitations. With participants from 131 countries, this global event has successfully brought together aspiring game developers and designers. A staggering 79,182+ games were created this year, showcasing the incredible talent and innovation within the gaming community. In India, the participation spanned across 12 states, including major cities such as Delhi (56 participants), Mumbai (32 participants), Bangalore (136 participants), Dehradun (111 participants), Ahmadabad (172 participants), Chandigarh (39 participants), Chennai (51participants), Pune (39 participants), Sricity (128 participants), Hyderabad (78 participants), Roorkee (46 participants) and Kolkata (23 participants).

The Kolkata region, represented by 23 participants, featured students who are specializing in game development and 2D game art, including the remarkable trio- Sahil Sarkar, Tanmay Mukherjee, and Amit Kumar, alongside Dippendu Hazra of Red Apple Learning. Together, they achieved a significant milestone by submitting their collaborative game, “Tomato Takedown,” within the challenging 48-hour timeframe of the jam. Much like a hackathon, the GGJ inspires participants to unleash their creativity based on a central theme unveiled at the beginning of the event. This convergence of talent and dedication marks the GGJ as a pivotal platform for fostering innovation and camaraderie in the dynamic realm of game development.

The structure of the GGJ in Kolkata mirrored its global counterpart. Participants gathered on a Friday late afternoon to witness a video keynote, featuring advice from eminent game developers around the world. As the clock ticked, a secret theme was revealed, serving as the creative catalyst for all jammers. The challenge was set: create compelling games based on the theme, with the final products to be unveiled by Sunday afternoon.

Satyajit Chakraborty, organizer of the Global Game Jam in Kolkata, emphasized the event’s importance. He highlighted that the GGJ brings together gaming enthusiasts globally and provides a platform for local talents to showcase their skills on the world stage. The event serves as an encouraging space for young minds to explore innovative ideas and forge their way to success in the gaming industry.

Tanmay Mukherjee, one of the participants, shared his enthusiasm for the event, saying, “I enjoyed the event very much. I needed to apply the applications or the knowledge acquired from my mentor during my game development course. Additionally, not only did we get to know so many things that will undoubtedly aid our transformative journey to becoming successful game developers, but we also learned the art of teamwork. Nazara Technologies’ esports subsidiary NODWIN Gaming will invest EUR 8 Million (INR 71.8 Cr) into German marketing services company Freaks 4U Gaming GmbH which specializes in gaming and esports marketing services. Just days ago, NODWIN Gaming invested an amount equivalent to INR 33.26 Cr in Freaks 4U Gaming GmbH through convertible notes.

Under this agreement, NODWIN and Freaks 4U Gaming will begin sharing resources from each other’s key regions, including staff as well as equipment and facilities. Furthermore, NODWIN will have access to Freaks 4U Gaming’s network across advanced markets as well as PC ecosystem services provided by Freaks 4U Gaming; Freaks 4U Gaming in turn will gain access to NODWIN’s market-leading network and facility capabilities in mobile youth culture and esports ecosystems according to filing. NODWIN has recently embarked on an aggressive growth strategy through acquisitions and investments, most recently announced by their full stake purchase of Comic Con India for INR 55 crore ($6 Million) through cash and stock exchange transactions. The company made headlines last year when it acquired 51% in mediatech startup Branded for $1.3 Million through a cash-only deal that cost them only $0.9 Million. NODWIN also acquired stakes in Branded during April. Furthermore, their gaming accessories company Wings acquired 35% ownership for INR 10.01 Cr.
